• Access additional features as per their subscription plan

5. User Accounts and Registration

5.1 Account Creation

To use our Services, you must create an account by providing accurate, complete, and current information including your name, email address, and password. You are responsible for maintaining the confidentiality of your account credentials.

5.2 Account Security

You are solely responsible for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other breach of security.

5.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in any fraudulent, abusive, or illegal activity.

6. Subscription Plans and Payments

6.1 Pricing

Our Services are offered through various subscription plans and credit-based pricing. Current pricing is available on our Pricing page. We reserve the right to modify pricing at any time, with notice to existing subscribers.

6.2 Payment Terms

All payments must be made in advance. We accept payments through various methods including credit cards, UPI, and other payment gateways. By providing payment information, you authorize us to charge the applicable fees.

6.3 Automatic Renewal

Subscription plans automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current rate for your plan.

6.4 Credits

Credits purchased are non-refundable and expire according to your subscription plan. Unused credits do not roll over unless specified in your plan.

7. Refund and Cancellation Policy

7.1 General Policy

All payments made to OMS VISION SOLUTIONS LLP (Elites Studio AI) are generally final and non-refundable. Clients are encouraged to review service details and try our free tier before making payments.

7.2 Exceptions

Refunds will only be considered in the following limited scenarios:

• Duplicate payment made accidentally
• Payment successfully deducted but service not activated due to a technical error at our end (excluding issues arising from payment gateway or client-side errors)

For such rare cases, a written request must be submitted within 7 (seven) days of the transaction by emailing us at support@elitesecom.ai.

7.3 Cancellation

You may cancel your subscription at any time from your account settings. Cancellation will be effective at the end of the current billing period. No refunds will be provided for partial billing periods.

8. User Content and Intellectual Property

You retain all ownership rights to the product images you upload ("Your Content"). By uploading Your Content, you grant us a limited, non-exclusive license to:

• Process and store Your Content to provide the Services
• Generate AI-enhanced images based on Your Content
• Use anonymized data for improving our AI models

8.2 Generated Images

You own the AI-generated images created from Your Content. You may use these images for any lawful commercial purpose, including marketing, advertising, and sales.

8.3 Our Intellectual Property

The Elites Studio AI platform, including all software, algorithms, designs, logos, and trademarks, are owned by OMSVISION SOLUTIONS LLP. You may not copy, modify, distribute, or create derivative works of our intellectual property.

8.4 Content Restrictions

You agree not to upload content that:

• Violates any intellectual property rights
• Contains illegal, harmful, or offensive material
• Depicts minors in any inappropriate manner
• Contains malware or malicious code
• Violates any applicable laws or regulations

All disputes arising out of or incidental to these Terms shall be settled through Arbitration before a sole Arbitrator appointed by the Company, under the Arbitration and Conciliation Act 1996 (Indian Government Act) or as amended. The place of arbitration shall be Mumbai, India.

These Terms shall be governed by and construed in accordance with the laws of The Republic of India. The courts of Mumbai shall have exclusive jurisdiction to entertain any disputes.

14. Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Services will immediately cease.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Services after changes constitutes acceptance of the modified Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
